In den meisten EU Mitgliedstaaten, können Verbraucher Mängelrechte nur für solche Mängel geltend machen, die bei Übergabe der Kaufsache vorhanden waren. Die Beweislast zum Nachweis, dass ein Mangel bei Übergabe vorgelegen hat, geht grundsätzlich nach Ablauf von 6 Monaten nach Übergabe auf den Verbraucher über.
Im Klartext heißt das: Tritt ein Mangel innerhalb von 6 Monaten auf, so gilt dieser Mangel als vorhanden bei Übergabe. Der Käufer kann die Kaufsache, Nacherfüllung verlangen, umtauschen oder sich das Geld erstatten lassen. Die nähere Ausgestaltung der einzelnen Mängelansprüche im Kaufrecht ergibt sich aus §437 BGB.
Was viele nicht wissen:
Apple – stets und mit weitem Abstand führend in der Zufriedenheitsstatistik – geht hier noch eine Schritt weiter und bietet einen Anspruchszeitraum von einem Jahr ohne Umkehr der Beweislast.
Im Klartext heißt das: Der Käufer muss im Falle eines Mangels, der innerhalb eines Jahres auftritt, nicht beweisen, dass dieser Mangel schon beim Kauf vorhanden war.
Apple bietet also den Käufern seiner Hard- und Software doppelt so viel Zeit für Gewährleistungsanspräche, wie es die deutsche und europäische Form vorschreiben.

iPad 3 kommt am 7. März.

Apple läd ein.
Gerechnet wird mit der Vorstellung des neuen iPad der 3. Generation. Dafür spricht auch die Art der Einladung:
Die Einladung bezieht sich auf den 7. März, 10 Uhr Ortszeit San Francisco im Yerba Buena Center for the Arts. Erwartet wird für das iPad 3 ein Retina-Display, LTE-Funktionalität, sowie ein schnellerer Prozessor.

ABC’s Nightline was given exclusive access to a Foxconn factory in China that assembles Apple products, providing a fascinating look at how Apple gear is made.
You’ll see iPhones, iPads, and MacBook Pro’s being put together manually by workers as there’s virtually no robots or automation, nearly all of the devices are assembled by hand. T
This means it takes a while to produce each Apple product, and a single iPad takes nearly a week to complete.
